We all know that the U.S. Citizenship and Immigration Services has stopped premium processing for lot of visa categories. Now the U.S. Department of Homeland Security (DHS) is considering a rule to open premium processing for more case types including applications to extend or change nonimmigrant status I-539 and applications for employment authorization I-765. This will benefit lot of applicants during this pandemic times. The regulatory agenda says that this rule may be released in September 2021 but is subject to change. After the USCIS issues the regulation, it is still unclear that how long it will take for the changes to go into effect. The Continuing Appropriations Act 2021 (CAA) also issued guidelines to DHS regarding premium processing fees and processing times. We will have to wait a month for more details and clarity.
